TERMS AND CONDITIONS OF SALE

These Terms and Conditions shall apply to any sale made through the website, www.caffeking.it, or the Customer Service, +39.0565.774253. These General Terms and Conditions of sales comply with the applicable e-commerce laws, especially Legislative Decree no. 206 dated 6th September 2005, n. 206 (Codice del consumo).

Parties

This Agreement is entered into by and between:

Caffe King of Loc. Del Casone Ugolino, 28/30 – 57022 Donoratico (LI) – VAT no. 01078240494

And

The Buyer: a consumer or natural person, as opposed to a legal person, who called Caffè King or visited www.caffeking.it and placed an order with Caffé King, which accepted such order.


Enforcement and amendments

By placing an order according to these General Terms and Conditions, you agree upon the instructions provided through the purchasing process and unconditionally accept these General Terms and Conditions. Caffé King may change these General Terms and Conditions and shall post such changes on the website. The applicable General Terms and Conditions of Sales at the time of your purchase shall apply to your order. No change in the General Terms and Conditions shall apply until it is posted on the website.

To login to our website, you only have to enter your shipping and billing details.

Goods and products; Prices

The pictures of the goods may slightly differ in colour, size or accessories from the actual goods you will receive. Any information about the goods is only intended as general information and is not specific to any product. Goods are sold at the price shown on the website at the date of your order. Prices include VAT, as detailed in the invoice. Shipping and delivery charges are not included in the price and are shown on the last page, just before you send out your order, and in the Order Confirmation that will be emailed back to you.

Orders

Orders will be accepted from: Italy, Republic of San Marino, Vatican City, and foreign countries as applicable.

There are restrictions on the amount of goods that can be ordered; all goods available until stocks last. Any promotional code offered by Caffè King and its stock partners shall only apply to such products and only for a specific period. Promotional codes are not refundable and may not be combined with any other promotion. To use the discounts and/or deals associated with promotional codes, enter the promotional code in the box when you place your order on the website. If you forget to enter your promotional code, you cannot cancel or replace your order. You must be 18 or older to place an order on the website. The ordering and purchasing process is clearly explained in the text and diagrams, in the pages of the website. Once you confirm your payment, your order cannot be cancelled or changed.

Confirmation and acceptance

As soon as it receives your order, Caffè King will automatically confirm your order by email, summarising all the details of the order. As soon as it receives your order, Caffè King will check if the products are available and then, if they are, it will confirm acceptance and shipment of your order. If Caffè King cannot handle your order, it will send you a notice to such effect as soon as possible. You will not be entitled to any refund for damage, and Caffè King will not be liable for any direct or consequential damage and/or injury that may arise out of or in connection with the rejection of an order.

Payments

Caffè King accepts payments by:

  • PayPal: an online payment system, which may be used by anyone who has an email address to send or receive payments. Registration required. Payments are handled through PayPal.

Shipping 

Goods will be shipped and delivered only in Italy, in the Republic of San Marino and Vatican City, or outside of Italy as applicable. Caffè King will ship the goods to the address specified in the order. Orders will not be shipped to PO Boxes.

Caffè King will ship the goods through a courier service to the Buyer’s address, in approximately 24 hours of acceptance of the order. Goods are usually delivered within 4 workdays. Delivery times are approximate. Shipping charges are based on the rates posted on the website or as notified by the Customer Service when you place your order. The Buyer shall be responsible for any tax or customs duty applicable in the Buyer’s place of residence. The courier service shall be responsible for delivery. Please report any missed or late delivery to the Customer Service of Caffè King, so Caffè King may assist you in defending your rights.

Acceptance of delivery

Immediately report any damage you may find in the packaging and/or goods or in the number of parcels or information by writing a note in the shipping papers. By signing the courier’s papers, you accept your products as undamaged and as matching your order. If you find any problems with the state, consistency or amount of products you received, please send an email to info@caffeking.it or call +39.0565.774253 within 10 workdays of delivery.

Billing

If you wish to receive an invoice with your order, please enter your social security number or, if you are a business or a professional, enter your VAT registration number. The billing details on the invoice will be based on the information you enter when you place your order. Once issued, the invoice may not be changed. When you place your order, please state if the billing address is different from your shipping address. If you do not enter your social security number or, if you are a business or professional, you do not enter your VAT registration number, Caffè King will not issue any invoice and will not issue any receipt or any other evidence of payment (pursuant to art. no. 22, paragraph 1, Presidential Decree no. 633/72, and art. 2, letter 00), Presidential Decree no 696/96).

 
Returns and refunds

Termination and return policy, pursuant to Legislative Decree no. 21 dated 21st February 2014, in implementation of EU Directive no. 2011/83/EU on consumer rights.

If you are not satisfied with your purchase, you can return it within 14 days of delivery and we will refund you for the cost of the purchase; the procedure is described below: 


1. Within 14 days of delivery, send a registered letter with advice of receipt to Caffè King or any other notice to such effect. Send the notice within 14 days by telegram or email to info@caffèking.it or call our Customer Service at
+39.0565.774253. If you have lost your delivery note, call
Customer Care at +39.0565.774253 or send an email to info@caffeking.it to receive the number of the delivery note, which you can then enter in the notice of termination.


2. You will be contacted by Caffè King for instructions on how to return your goods.

You shall return your purchase within 14 days of our notice.

Refunds include shipping charges.

If the value of your purchase has been reduced as a result of not having been used as intended to understand its nature, properties or purpose (e.g. if the goods have been damaged, improperly or inadequately packaged, have missing or damaged parts, such as components, features, attachments, packaging materials, papers and/or other items), Caffè King will subtract such reduced value from the refund. If you return your purchase after the deadline or if it has been opened and/or partly used or cannot be returned, our return policy will not apply, and Caffè King will send the goods back to you, at your expense.

Except on such circumstances, Caffè King will refund you for the cost you actually paid within 14 days of your notice, by bank transfer or credit card or cheque.


Warranty
All non-food products sold by Caffè King are covered by the manufacturer’s standard warranty and by a 24-months warranty, in accordance with Legislative Decree no. 24/2002, as amended, and articles no. 130 and 132, Legislative Decree no. 206/2005. To use such warranty coverage, keep your invoice or, if you do not have one, keep the delivery note. If you find that the products you bought are faulty and/or have been damaged while shipped, you can have them replaced if you send notice by telegram or email to info@caffeking.it or call the Customer Service at +39.0565.774253 within 10 days of delivery. You shall return the faulty or damaged goods in their full and original packaging. The shipping charges for the replacement of your product shall be borne by Caffè King. Caffé King will replace the faulty and/or damaged goods with identical ones or, if no longer available, will send you goods of equivalent value, if you agree.

Place of jurisdiction

These sales of goods and/or services whether in Italy or abroad shall be governed by and construed in accordance with the law of Italy. The courts set forth by Italian law at the time of entering the Agreement shall have exclusive jurisdiction on any litigation.
